Dr. Daniel Gutman, LL.M. (Otago)

Dr. Daniel Gutman has been working in commercial law and white-collar criminal law from a wide range of perspectives since 2005.

With his diverse expertise – as a lawyer both in a large international law firm and in a boutique specializing in white-collar criminal law, as a public prosecutor, and as a judge dealing with (commercial) criminal matters across three levels of jurisdiction, as in-house counsel in companies in the healthcare sector and in one of the Big Four auditing firms – combined with his international orientation, he is a valuable member of advisory and defense teams in major internal investigations, complex corporate and individual defense cases (particularly at the C-level), sophisticated compliance and prevention programs, as well as in all matters concerning the professional regulations of auditors and tax advisors.

  • Born in 1977 in Berlin
  • Studied law and economics at the Free University of Berlin, the University of Vienna, and the University of Otago (New Zealand); legal clerkship in Berlin, Potsdam, Cologne, and Sydney (Australia)
  • Doctorate in law (Dr. jur.) in 2004 and completion of a Master of Laws (LL.M.) in 2007.
  • Admitted to the bar from 2005 to 2016 and again since 2026, initially working in corporate litigation at Gleiss Lutz in Berlin and Stuttgart, followed by five years as Deputy Head of the German Legal Department of KPMG AG Wirtschaftsprüfungsgesellschaft (including roles within the Office of General Counsel team of KPMG Europe and KPMG International), partner at Knierim | Huber (later Knierim & Krug) where he established the Berlin office, as well as General Counsel and Vice President Legal & Compliance at Biotronik SE & Co. KG and Head of Legal at K3B Health GmbH.
  • From 2016 to 2025, he served as a judge in the Berlin judiciary, including at the public prosecutor’s office, for many years as presiding judge of a commercial lay judge division at the Tiergarten District Court, as a judge at the Regional Court of Berlin I in the chamber for auditor matters, a commercial criminal chamber, and at the Berlin Court of Appeal in the 5th criminal senate.
